Terms and Conditions of Service
DIVAL CONSTRUCTION INC. · Last updated November 2, 2026
These terms apply to quotes, contracts and work carried out by DIVAL CONSTRUCTION INC., and to your use of this website.
1. About these terms
These Terms and Conditions of Service govern your use of this website and the construction, metal roofing, cladding, renovation and addition services provided by DIVAL CONSTRUCTION INC. ("DIVAL", "we", "us") in Toronto and the Greater Toronto Area.
By using this website, requesting a quote, or engaging us to carry out work, you agree to these terms. If you do not agree, please do not use the site or our services.
2. Quotes and estimates
Quotes are prepared from the information available at the time of enquiry, including measurements, drawings, photographs and site conditions observed during a visit. A quote is valid for 30 days from its date unless it states otherwise.
A quote is not a binding contract. Work begins only once the scope, price, schedule and payment terms have been accepted in writing by both parties and any agreed deposit has been received.
3. Scope of work and changes
We carry out the work described in the accepted written scope. Anything not described in that scope is excluded.
Changes requested during the project (additional work, material upgrades, layout changes, or work required because of concealed conditions) will be confirmed in writing before being carried out, and may change the price and completion date.
4. Site access and client responsibilities
You agree to provide safe and reasonable access to the property and work areas, to keep the work area clear, to make water and power available where reasonably required, and to remove or protect valuables and fragile items before work begins.
You agree to disclose known hazards or concealed conditions on the property, including previous water damage, asbestos, mould, underground services and structural alterations.
5. Permits, drawings and approvals
Where a project requires a building permit, engineered drawings or condominium or municipal approval, those requirements will be identified in the quote. Permit fees, engineering fees and consultant fees are payable by the client unless the quote states otherwise.
Scheduling is subject to permit issuance and inspection timelines, which are outside our control.
6. Materials, subcontractors and substitutions
Materials are supplied as specified in the quote. If a specified product becomes unavailable, we will substitute a product of equal or better quality and confirm the change with you before installation.
We may engage qualified subcontractors and trades for portions of the work. We remain responsible for the coordination and quality of the work we contract to perform.
7. Pricing and payment
We accept payment by credit card, wire transfer and Interac e-Transfer. Payment terms, including deposits and progress payments, are set out in the accepted quote or contract.
Invoices are due as stated on the invoice. Overdue amounts may attract interest at 2% per month (24% per annum), calculated from the due date until paid. You are responsible for reasonable costs of collecting overdue amounts.
Payment card details are handled by our payment processor. We do not store full card numbers.
8. Scheduling and delays
Start and completion dates are provided in good faith. Weather, material lead times, permit and inspection timing, site conditions and changes to the scope can affect the schedule.
Where a delay is caused by something within our control, we will tell you promptly and agree a revised schedule. We are not responsible for delays caused by events outside our reasonable control.
9. Workmanship, materials and warranty
We carry out work in a good and workmanlike manner, in accordance with applicable building codes and the manufacturer instructions for the products installed.
Manufacturer warranties on materials are passed through to you. Workmanship warranty coverage and duration are as stated in your contract. Warranties do not cover damage caused by others, misuse, lack of maintenance, normal weathering or alterations made after handover.
10. Cancellation
You may cancel before work begins by written notice. You will be responsible for materials already ordered that cannot be returned, design, engineering or permit costs already incurred, and any deposit terms stated in your contract.
If you cancel after work has started, you will be invoiced for work completed and materials ordered up to the date of cancellation.
11. Limitation of liability
To the extent permitted by law, our total liability arising from the work or from use of this website is limited to the amount paid by you for the work giving rise to the claim. We are not liable for indirect or consequential losses, including loss of income, profit or opportunity.
Nothing in these terms excludes or limits rights you may have under the Consumer Protection Act, 2002 (Ontario) or any other applicable law that cannot be excluded.
12. Website content
Photographs, project descriptions and materials shown on this website are representative examples and may not reflect every product or finish available. Colours and finishes can vary between production runs and under different lighting.
We may update, change or remove content on this website at any time without notice.
13. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
If a concern arises, please contact us first so we can try to resolve it directly. Unresolved disputes are subject to the exclusive jurisdiction of the courts of Ontario.
